1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of MyInstants Pro ("MyInstants Pro," "we," "us," or "our") at myinstantspro.com, including our meme soundboard, sound downloads, AI Sound Lab, Discord bot integration, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy and DMCA Policy. If you do not agree, do not use the Service.

2. Eligibility

The Service is intended for a general audience. If you are under 13 years of age (or the minimum age required in your jurisdiction), you may use the Service only with the consent and supervision of a parent or legal guardian. By using the Service, you represent that you meet this requirement or have obtained such consent.

3. Description of the Service

MyInstants Pro provides a free, browser-based library of meme sounds, sound effects, and related audio clips. Features may include:

• Streaming and downloading audio files for personal use
• Category browsing, search, favorites stored locally in your browser, and pitch controls
• AI-generated sound creation through the AI Sound Lab, subject to daily usage limits
• Discord bot installation and voice-channel playback through third-party platforms
• Embeddable players and shareable links for individual sounds

We may add, modify, or discontinue features at any time without prior notice. The Service is provided on an "as available" basis.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws, school or workplace policies, or platform rules (including Discord, TikTok, YouTube, or Twitch terms)
• Harass, threaten, defame, or harm others, or use sounds to disrupt classrooms, workplaces, or public spaces in a manner that violates reasonable conduct standards
• Scrape, crawl, bulk-download, or automate access to the Service in a way that degrades performance or bypasses rate limits
• Attempt to gain unauthorized access to our systems, databases, or third-party integrations
• Upload, generate, or request content that is illegal, sexually exploitative, hateful, or infringes third-party rights
• Resell, sublicense, or commercially redistribute our audio library or AI outputs without separate written permission
• Misrepresent affiliation with MyInstants Pro or impersonate our team

We reserve the right to restrict or terminate access for conduct we reasonably believe violates these Terms or harms the Service or its users.

5. Intellectual Property

The MyInstants Pro name, logo, website design, and original site content are owned by us or our licensors. Many sounds available on the platform originate from third parties, including memes, games, films, and user-submitted material. We do not claim ownership of all audio hosted on the Service.

If you believe content on the Service infringes your copyright, please follow the process described in our DMCA Policy. We respond to valid takedown notices and may remove or disable access to disputed material.

6. AI Sound Lab & Generated Content

When you use the AI Sound Lab, you submit text prompts that are processed by third-party AI services to generate audio. You are responsible for the prompts you submit and how you use generated output.

• Do not submit prompts designed to reproduce copyrighted voices, songs, or trademarked characters without authorization
• Generated sounds may be saved to our database and made available in the AI Generated category for other users to play
• AI output may be imperfect, inaccurate, or unsuitable for your intended use — verify before publishing or distributing
• We may impose daily generation limits, moderation, or removal of AI content at our discretion

7. User Submissions & Sound Requests

If you submit a sound request, feedback, or other material through the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, host, and display that submission for the purpose of operating and improving the Service. Do not submit material you do not have the right to share. We are not obligated to publish or act on any submission.

8. Downloads, Sharing & Personal Use

Unless otherwise stated, sounds are provided for personal, non-commercial entertainment — including memes, streams, videos, and Discord voice chat — subject to third-party rights and platform policies. You are solely responsible for ensuring your use complies with copyright law, fair use, and the rules of any platform where you publish content. Commercial redistribution of our full library or bulk archives is not permitted without written consent.

9. Discord Bot & Third-Party Services

Our Discord bot and other integrations rely on third-party platforms not controlled by us. Your use of Discord is governed by Discord's own terms and privacy policies. We are not responsible for outages, policy changes, or actions taken by third-party platforms. Links to external sites do not constitute endorsement.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT AUDIO WILL REMAIN AVAILABLE INDEFINITELY.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYINSTANTS PRO AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

We may suspend or terminate access to the Service, with or without notice, for any reason, including maintenance, abuse, or legal compliance.

14. Governing Law & Disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where prohibited by applicable consumer protection laws in your country of residence.
